NMU: Omadino Community seeks leave of Federal High Court to institute action against Buhari, National Assembly


The Dr. Robinson Eyokosi  led Omadino Management Committee and the Omadino Council of Elders today, January 31, filed an application before the Federal High Court in suit No:  FHC/WR/CS/15/18 between Dr. Robinson Eyokosi  Uwatse & 4 others Vs. President of the Federal Republic of Nigeria & 6 others, seeking leave of court as required by law to issue and serve legal processes on the President of the Federal Republic of Nigeria, the Senate President, the Speaker of the House of Representatives, the Attorney General of the Federation(AGF) amongst others, calling upon the Honourable  Court to determine the question of the legal name of the proposed maritime university.

Speaking with reporters, Mrs. Tsaye Mene, a member of the said Committee lamented that the legal action became necessary to save the Nigerian State from relapsing into the Hobbesian state of nature.

 She said that in her few years of exposure to modern civilization, She knows of no constitutional democracy where the highest court in the land in a country would settle a dispute amongst disputants and the legislative arm will turn around to conspire with other enemies of the state to sit on appeal over the decision of the Supreme Court.

In her words, “It is now clear that the protracted argument about the naming of the Nigerian maritime University can only be resolved through one of two means; either the use of force and threat to our national economy or the use of the democratic institution like a competent court of law. Our fore fathers have been consistent on the latter option. While we might be constrained to explore the first option, we want to exhaust the latter option”.

 According to her, the Omadino Committee would hold on to the last straw of hope in the Judiciary, hence the step to institute the action, expressing hope that the matter should not degenerate as such would be most unfortunate.
