A Delta State Court of Justice, holden in Warri, earlier today, Thursday March 11, reportedly struck out a suit, seeking to invalidate, the inauguration of the Comrade Weyinmi Agbateyiniro led executive of Itsekiri National Youths Council, INYC for a second term.
The Presiding Justice, Mrs. V.O. Agboje, in her ruling, reportedly held that the claimants could not present the conventions and protocols of INYC, on which they sought their six prayers.
According to Justice Agboje, on point of law, whatever is asserted must be proven.
The Claimants; Messrs David Iwere, Omatseye Tuasor, Tuoyo Ofuyaekpone, Edema Collins and Bawo Edeoyibo, had approached the court in suit No: W/259/2020, seeking six orders, including “setting aside the purported inauguration of the INYC Executive by the defendants, their agents, servants and or privies”.
They also wanted the court to declare as illegal, null and void, “the planned inauguration of the Executive of INYC (led by Comrade Agbateyiniro, for a second tenure)”.
Fresh Angle International can report that the defendants in the suit, which proceedings started January this year (2021) are; Comrade Weyinmi Agbateyiniro, Appearance Afejuku and Ernest O.T. Ekpoto.
The Vice President of INYC, Godwin Utieyin, Secretary; Appearance Afejuku, Financial Secretary; Ernest Ekpoto, the Director of Mobilization of the Council; Dere Jarikpe and the Warri South Chapter Chairman of INYC; Ofoyeju Izuagie, were among 20 INYC members that witnessed the court ruling today.
While Clement Omotoye Esq. stood as Attorney for the claimants, Presley O. Okojie Esq. represented the Defendants.
Recall that during the climax of the 5th Coronation Anniversary of The Olu of Warri, Ogiame Ikenwoli, the Monarch explained why the Comrade Weyinmi Agbateyiniro led executive of Itsekiri National Youths Council, INYC, was granted another one tenure of four years,.
The Monarch explained: “The tenure of the executive Council of the INYC expired in October. But before now, I had directed that the two factions of the council operating under separate constitutions, with two separate CAC registration certificates, be merged into one. I had also requested that a proper Board of Trustees be established to help pilot and guide our youths in the conduct of the affairs. These directives have yet to be followed. I therefore, in consultation with my chiefs, community elders and some identified leaders of the youths themselves, made a decision for the Weyinmi Agbateyiniro led executive to continue for a maximum of another one tenure of four years, so that all of these issues can be properly sorted out. I hear some people are unhappy with this and are heading to court. I appeal to all aggrieved people to sheath their sword and, instead come forward with ideas to build a better and more virile youth organization.”
