In the petition dated September 13, 2021 entitled: “A CASE OF THREAT TO LIFE, BURGLARY, STEALING, INTIMIDATION AND MALICIOUS DAMAGE TO PROPERTY, PERPETRATED BY ONE MR JIMOH ABUBARKA FRANCIS OF PLOT NO: 705 BENDEL ESTATE, OFF AIRPORT ROAD, DDPA, EFFURUN, AGAINST ME AND FAMILY”,  Esiegbuya, alleged that the Police team from ‘A’ Division Warri, in-company of community thugs came to his compound: “In about four Sienna Space Buses and harmed with dangerous weapons, such as Guns, Battle axes, Sledge hammers and other carpentry tools, with a wooden ladder, to which they the Policemen scaled my perimeter fence that fateful day of the incident and invaded my house for no reason”.

He added: “While in the same process, our privacies were intruded by them, even when Mr. Jimoh Francis, the prime suspect was aware of the yet unresolved monetary issues that was dangling on his neck, which we had together and could probably not resort to such criminal or murderous activities carried out against me and my family and more so, after the said Policemen had succeeded in burgling my house, they ostensibly and unlawfully searched all the rooms to my apartments for no justifiable or culpable reasons, nor found any incriminating material in my house and in the same process they the Policemen with the thugs carted away and destroyed properties worth millions of naira in the premises, including cash of about (N-72, 000.00) Seventy two thousand naira only, inside drawer. One Toshiba Satellite laptop computer worth (N-140, 000.00) with serial no: x7272766Q, my Zenith Bank Plc Cheque booklet bearing the name Samtek Global Electrical Company Limited, handsets and other valuables, while my tenants living in the same compound, were harassed and thereafter they maliciously damaged my Water Pump Machine, Electricals and plumbing pipes installation at the premises for the reason that I did not  know (sic) and/ or the offence that I may have committed to warrant this kind of oppressive and intimidatory brutality from them without due recourse to the law by the said law enforcers ( Policemen) from the ‘A’ Divisional Police Command”.

According to him, the Policemen and the thugs forcefully broke into his apartments in his absence, met his estranged wife, Mrs. Georgina Esiegbuya, his four female children and his house maid, Mercy, “who was badly assaulted and beaten up before they picked up my wife, Mrs. Georgina and took her along with them, first to Ubeji Community Police Station and thereafter taken to "A" Divisional Police Command, Warri for no culpable offence known to law, before she was later released to her family, after couple of wasted hours of unlawful detention”.

Mr. Esiegbuya, informed the CP: “This matter has been fallow and/ or left unattended to this while, due to some unlawful circumstances that restrained my liberty and now that I am free, I am writing to demand justice in the circumstances of the entire criminal activities of Mr. Jimoh Francis, the unscrupulous Policemen from the "A" Divisional Police Command, Warri, who allowed themselves to be used as tools, despite law enforcers and the hired thugs from the same Community.

“Sir, Kindly find attached photograph copies of the foreign doors damaged, the ladder used in scaling the perimeter fence surrounding my storey-building for security purposes, the manhole in the house to the ceiling to which the Policemen accessed the hole looking for me with a torch light, if they find me inside the ceiling to  assassinate and also pictorials of rooms ostensibly searched by the Policemen and thugs in the causes of their unlawful invasion and other criminal acts committed as Annexure A, B, C, D, E, F and G respectively for your sighting and probable action.

“It would be in the interest of justice in line with the mandate of the police, if you would please direct your Men and Officers to conduct diligent, effective,  expeditious and  thorough investigation into this matter of lives and property within the purview and obligation of the Nigeria Police Force to bring the said Mr. Jimoh Francis and his cohorts to accountable on this erroneous, dastardly acts, height of impunity, ultra vires and penchant disregard for the rule laws jointly orchestrated by them the suspects against me and my family and at my peaceful abode to serve as a deterrent to other crime intenders in the society”.
