Prehearing is the session at which preliminary issues are treated before hearing commences. Prehearing in this case has been on for some time now until today the 5th day of August, 2015 which was the last day. The case has now proceeded to hearing on the 10th day of August 2015.
At the last prehearing day, Omawumi Udoh contended that since she did not win the election she and her party want to opt out before the trial commences.
The law is that where a person is joined as a Respondent and contends he or she did not win an election and does not want to pursue the case, such a party is allowed to go.
This was what happened today in respect of this petition.
Now today also INEC tried to remake an application to file its reply which had been earlier denied for being out of time. The Tribunal again refused INEC.
This matter has now been adjourned to 10th August for hearing for the first time. The Petition filed by Barr Ariyo is only one not two and Bar Ariyo participates only in one not two petitions.
This Petition was not struck out.
