POSITION STATEMENT AND FORMAL DISASSOCIATION FROM THE PROPOSED AFFIRMATIVE AFFIDAVIT ON THE ORIGIN AND OWNERSHIP OF KOKO COMMUNITY

This statement is issued to clearly explain the position of concerned members of the NANNA family of Koko Community regarding the proposed affirmative affidavit on the origin and ownership of Koko Community.
 
The Nanna family clearly states that it is not part of, and does not support, the proposed affirmative affidavit. We reject any attempt to use such affidavit to explain, change, replace, or override existing court judgements, especially judgements given by superior courts.
 
During proceedings at the High Court in Oghara in the first week of October, 2025, evidence was given under oath in a pending case. In that proceeding, efforts were made by counsels on the opposing side to present an alleged consent judgement linked to the lweroko and Ameren group through a witness. This efforts were unsuccessful. This confirms that the said consent judgement is disputed and remains a matter of legal disagreement.
 
It is therefore worrying that, after these failed attempts in court, efforts are now being made to use another method by encouraging or pressuring an elder of the community to sign an affidavit on matters he is said not to fully understand. Any such actions raises serious legal and moral concerns and may expose all involved persons to punishment under the law. 
 
For clarity, no member of the NANNA family, regardless of position or title, has the power to use an affidavit to change, interpret, or cancel the judgement of the Supreme Court or any other binding court decision.
Court judgement can only be reviewed or changed by a court with the proper authority, and not by private affidavits or community documents.
 
It is also important to state that there is an existing court order restraining parties, including Pa. Anthony Nanna, from signing or taking part in the execution of the proposed affirmative affidavit. Any action taken against this order would amount to contempt of court and carry serious legal consequences.
 
Furthermore, the Supreme Court judgement of 1958, which confirmed the ownership of Koko in favor of the NANNA family, remains valid and binding. That judgement cannot be cancelled, weakened, or replaced by any alleged consent judgement that is disputed and said to have been fraudulently obtained.
 
The Nanna family also expresses serious concern about long standing exclusion within Koko Community, especially in matters of leadership positions, employment opportunities, and fair sharing of community resources. Although the Nanna family is an indigenous part of the community, many of her descendants remain among the poorest and most disadvantaged.
 
There is increasing concern over a system that prevents qualified members of the Nanna family from holding important community positions, including leadership roles within the community and youth bodies. 
This situation has affected the welfare, dignity, and overall progress of the family.
 
Members of the Nanna family are therefore encouraged to carefully consider whether their welfare, future, and standard of living have improved under the current arrangement, and to question any system that promotes exclusion, inequality, or denial of rightful participation.
 
In conclusion, this statement is a call for Unity, alertness, and respect for the rule of law. All grievances will continue to be addressed strictly through the courts and other lawful means. The Nanna family remains peaceful, law abiding, and committed to justice, fairness, and the protection of it's ancestral rights. No amount of compelling by any person in authority will change a valid Court decision.
