Substituted Candidate of the Peoples Democratic Party, PDP in the October 25, 2014 Local Government polls in Delta State, Hon. Weyinmi Omadeli has prayed the three-man election Tribunal Chaired by C.O. Oloke (Mrs.) to order the immediate removal of Hon. George Ekpemupolo as elected Chairman of Warri South-West Local Government Area, insisting that he, Omadeli is the validly nominated candidate at the polls.
Hon. Omadeli in a petition filed on his behalf by Festus keyamo and four other lawyers, is also asking the Tribunal to declare the Certificate of Return Issued to Hon. George Ekpemupolo by the Delta State Independent Electoral Commission, DSIEC as null and void, stressing that the Certificate of Return be issued to him as the validly nominated candidate of the PDP.
While noting that he never had any formal notification of his purported substitution by the PDP and DSIEC, Hon. Omadeli declared that the name of Hon. Ekpemupolo was not published anywhere by the PDP and DSIEC, even as he claimed that the votes purportedly cast for Ekpemupolo on election day were for him.
Meanwhile, following the absence of Hon. George Ekpemupolo and his counsel on day one (December 1, 2014) of the Tribunal sitting in Warri, the Tribunal has directed that notice be served Hon. Ekpemupolo by substituted means or by advertisement in any newspaper circulating within the jurisdiction of the Honourable Court before the next sitting.
