IN RE -INCORPORATION /REGISTERATION OF IKPERE HOST COMMUNITY DEVELOPMENT TRUST (HCDT) FOR UGBORODO COMMUNITY:

 

7 (SEVEN) DAYS ULTIMATUM FOR CHEVRON NIGERIA LTD TO FACILITATE THE INCORPORATION OR REGISTRATION OFTHE ABOVE REFERENCED HCDT.

We act for the good people of Ugborodo community whose legal Representatives are:

(1) Eghare Daniel Uwawah; the Egare Aja of Ugborodo Community, (2.) Prince Perry Atete; the Igbajo of Ugborodo (3) Chief Ayiri Emami (4) Mr. Isaac Botosan (5) Mr. Alex Eyengho, etc, in this matter hereinafter also referred to as "our Clients".

Our clients informed us as follows:

1.That the underscored ommunity is host community to Chevron Nigeria Ltd (CNL) tank farm by vitue of which the Petroleum Industry Act, 2021 “as amended” (the Act) is the mother law regulating the relationship between QNL and the Community.

2.That the Act refered to in paragraph 1 above provides for the setting up of Board of Trustees for the host community by CNL in CNLs areasof operation in consultation with the host ommunity.

3.That sequel to the fact in paragraph 2 above, CNL incorporated what it calls “Warri Kingdom Onshore Host Communities Development Trust"which was meant to encompass our dients community in flagrance disrespect for the provision (s) of the Act, and NUPRCs (The Regulator) diredives -that is, without consulting with our Cients.

4.That fact in the preceding paragraph necessitated series of protests by our dients against CNL to night the wrongs by complying with the provision(s)of Act in the compostion and registration of the HCDT but to no avail.

5.That the development in paragraph 4 above necesstated yet another intervention by NUPRC (the Regulator) into the matter by convoking yet another tripartite (all stakeholders) meeting on the 16"day of July, 2024 whereat was resolved and duly executed by all paties (as it concemed our dients)that Ikpere HCDT shall be incorporated by the setlor in onsultation with our dients to over (Esaavos Terninal Area) Ode Ugborodo, Ogidigben, Ajudaibo, Madangho, Ijaghala, Ogboloegin and Ugboegungun.

6.That it was also part of the resolutions that setlor (CNL) shall proceed to Corporate Affairs Commission (CAC) to de register the illegal Warri Kingdom Onshore HCDT. For the avoidane of doubt,the refered resolution is herewith annexed as Annexture "AA".

7.That CNL in its usual characteristic manners had, to the dismay and chagrin of our Gients swept this all important resolution signed by itself under the carpet, dandestinely and sureptiously incorporated the same"Warri Kingdom Onshore Host Communities Development Trust'", meant to encompass our Clients'community,stil in blatant disregard for the provisions of the Act and our Clients'rights.

The above facts adumbrated, we have our dients'instrution as we herein do, to formally issue CNL a 7 day ultimatum within which CNL has, to incorporate the agreed "Ikpere Host Community Development Trust"for our Clients or isk a muli faceted means of pressing home our Cients'demand for justice in the circumstances.

RESOLUTION AT THE NUPRC TRIPARITE MEETING WITH CHEVRON NIGERIA LIMITED (CNL AND REPRESENTATIVES OF ITSEKIRI CHEVRON ONSHORE HOST COMMUNTIES)

Below are the resolutlions reached a the tripartite meeting held af Sandrala Hotel. Jabl Abuja on Tuesday 16th July 2024:

I. The meeting resolved thal Chevron Nigeria limited (CNL) should incorporate three HCDTs to replace the Warri Kingdom Onshore HCDT.

The Settlor in consultation wilth the Host Communities should incorporate three (3) new HCDI namely: IKPERE HCDT (Escravos Terminal Area) for Ode-Ugborodo, Ogidigben Ajudaibo, Modangho, Ijaghala, Ugboloegin and Ugboegungun communities.

Dibi and Olero Felds HCDT for Tisurn, Kolokolo, Ureju, Eghoro, Uor. Soghara-lie, Tebu, Ebrohimi, Obaghoro, Aja-amila, Udo, Gbokoda and Jakpa communities, Abiteye, Ulonana and Makaraba Flelds HCDT for Deghele, Bateren, and Omadino communities.

2. The composition and incorporation of Wani Coastal Host Communities' Development Trust is undisputed and all representatlves at the meeting are in agreement with it.

3. CNL shall proceed to the Corporate Affais Commission to de-register the Warri Kingdom Onshore HCDT.

4. The communities have agreed to give consideration to the Board of Trustee members of the previous Warri Kingdom Onshore HCDT in the new HCDTs according to their flelds.

5. The NUPRC shall within two weeks communicate the above (1-4) to CNL for implementation and complance.
