The Delta State High Court, sitting in Asaba, on Friday January 31, dismissed the suit filed by Prince Oyowoli Emiko, against the emergence of Prince Tsola Emiko, as the 21st Olu of Warri.
The Court, described the suit by Prince Oyowoli Emiko, as mere academic exercise " by withdrawing the previous suit to file a fresh suit."
The Court added: "By so doing, the claimants thought they could play a fast one, but ended up shooting himself on the foot."
According to the court, the letters of recommendation by the Executive Council, came after the suit was filed and the reliefs of claim in the suit " is premature."
Whilst describing the respondent' suit as statute barred, the court, asserted : " The grievances of the Claimant ought to be presented during the 21 days period provided for by the S.19 of the Traditional rulers council chieftaincy laws ."
Parties in the suit, were absent when the case was called today, but counsels were present.
