Indigene drags Warri Community head to Court over Quit Order


The Okere Community in Warri South Local Government Area of Delta has issued one of its sons and businessman a quit notice to vacate a certain portion of land or face whatever action that will result from his refusal.

This comes even as the indigene, Mr. Eric kiap has dragged the Okere Community head and 2 others to a Delta State High Court sitting in Warri to seek redress in Suit No. w/458/2017.

The Defendants (Okere Community) through its counsel, O.G. Fregene had in a letter dated 30th June 2017 issued and served the Claimant (Eric Kiap) a “Notice to vacate piece or parcel of land opposite Nana College Warri”, failing which he should leave himself open “to whatever actions are available”.

However, the claimant through his counsel, Jolone Ikomi in his statement of claim, averred that the land in question was granted to his father by then Itsekiri Communal Land Trust in the 60s, saying that in-spite of attending meetings with the Okere Community head and others previously, thugs were sent and forcefully entered into the land and started digging and demarcating the land.

He said that the action led to a fracas that was settled by the Divisional Police Officer, DPO, “A” Division Warri until the recent quit order notice.

He therefore sort a declaration of entitlement to the Certificate of Occupancy to the land in dispute and a perpetual injunction, restraining the Defendants and their agents from further trespassing on the parcel of land known as No. 37 Mabiaku Road, G.R.A, Warri, Delta State.

No date has been fixed for the hearing of the matter.
