A Medical Practitioner, two lawyers and a 72 -year old man have been arraigned at the Agbor Magistrate Court, Delta State for felony, forgery and alleged murder of the Eleme of Obi-Aiyima Community in Abavo kingdom, Chief Chukwuyemu, Our Delta North Correspondent reports. 

The four accused persons arraigned are: Joseph Chiyem, 72-year old, Dr. C.O Uzor, 59-year old, Barr. Sunday Okwuolise, and Barr. Ifeanyi Aghalor.

They were reportedly granted bail by the Chief Magistrate of the Court, Mr. Edward A. Odjugo, after they met bail conditions.

With a 5-count charge of murder, conspiracy, felony, threat to life and forgery preferred against the accused persons by the police, the police prosecutor, Mr. Christ Kpapuma told the court that the alleged offences were committed on the 9th December 2011.

According to the charge sheet, Joseph Chiyem and Dr. C.O Uzor, including two others were on the 9th December 2011 at Government House, Owa-Alero within Agbor Magisterial District conspired among themselves to commit felony to wit; forgery, an offence punishable under section 516 of the criminal code law cap c22 vol. 1 laws of Delta State. 

In count two, Dr. Uzor and others did forged a General Hospital Owa-Alero Medical Report No. AM2/OA Vol. 1/19 dated 19th December 2011 bearing the name of Chief Joseph Chiyem, an offence punishable under section 467 of criminal code law cap. c22 vol. 1 laws of Delta State.

In court 3, Chief Joseph Chiyem, and others did obtained Medical Report No. AM2/OA VOL.1/19 from Government Hospital, Owa-Alero, an offence punishable under section 467 of the criminal code law cap C22 vol. 1 laws of Delta State.

In court 4, Chief Joseph Chiyem on the 6th January, 2012 at the High Court of Delta State, Agbor Judicial Division did swore to an affidavit on oath as well as did file summons for bail that he was critically ill, and tendered the alleged forged report which deceived the court to admit you on bail, an offence punishable under section 118 of the criminal code law cal C22 vol. 1 laws of Delta State while in court 5, Chief Joseph Chiyem on the 6thJanuary 2012 at the High Court of Delta State, Agbor Judicial Division did made a false information to a public officer, the Judge of the High Court of Justice, Agbor Judicial Divisio, Justice, D.C Maidoh that he was ill and produced a forged medical report which made the Judge to make an order in his favour, an offence punishable under section 125A of the criminal code law cap C22 vol. 1 laws of Delta State.

Chief Joseph Chiyem had allegedly conspired with others in Obi Aiyima community to murder one Chief Chukwuyemu, the Eleme of Obi-Aiyima and was subsequently arrested, while others fled the community for fear of the unknown. 

But while Chief Joseph Chiyem was remanded in Agbor Prison Custody, he allegedly influenced and deceived the High Court in Agbor that he was critically ill, a situation Medical Report was allegedly forged for him. 

Granting the accused persons bail after meeting the bail conditions, Chief Magistrate Edward A. Odjiugo said, “however, this court is mindful of the fact the 3rd and 4th accused persons are lawyers but what is sauce for the goose is sauce for the gender” and adjourned hearing in the matter for 29th August, 2017.
