A five year old girl allegedly raped by a 39 year old man testified before an Evbuoriaria Chief Magistrate Court sitting in Benin City, Edo State about how the man who happens to be a neighbour in the same compound allegedly had unlawful carnal knowledge of her without her consent.
Our Benin City Correspondent reports that before the little girl was given the opportunity to testify, the Presiding Chief Magistrate, Mike Osayi Esq; asked the girl some preliminary questions. The little girl told the Chief Magistrate that she knows what truth was and anyone who tells lies would be punished by God.
Satisfied with the girl’s answers, Chief Magistrate Osayi said, “She appears intelligent enough to testify and has displayed sufficient intelligence in the number of questions put to her”.
In her evidence, the victim told the court that when her mother was away to work on 31st June 2012, the accused person, Saturday Udoh whom she knew as Papa Nini called her into his room, put her on his lap removed his trousers and thereafter, inserted his penis into her virginal.
She also testified that her virginal tore and blood started coming out from it, adding that when she started crying, the 39 year old man covered her mouth with his hands.
The little girl further testified that as at the time of the incident, her elder brother was in the house and she told him what transpired between herself and the accused.
According to the victim, when her mother returned from work on the day of the incident she told her mother who in turn told her father about what happened. During cross examination by the accused, the little girl maintained that she knew the man who sometime played with her in the house and buy her gifts.
When told by the accused person that someone instructed her to say what she was saying, the little girl responded that she was telling the truth and that her brother saw him taking her to his room.
She maintained that the Papa Nini told her brother that he was going to send her a message while taking her away, emphasizing that her father even gripped him before he was taken to the police station where she also told the police what the 39 year old man did to her.
The case has been adjourned to 5th September, 2012 to enable the prosecution call a police doctor to testify. In the mean time, the victim has been referred to a pediatric surgeon for possible operation.
The accused Saturday Udoh, popularly called papa Nini was alleged to have on 31st June 2012 at Falodom Country Home Motel Road, Benin City unlawful had carnal knowledge of the five year old girl, an offence punishable under section 218 of the criminal code cap 48 Vol. II laws of the defunct Bendel State of Nigeria 1976 as applicable in Edo State.
