Delta State High Court, Warri Judicial Division, presided over by Honourable Justice N.E. Emudianohwo (Mrs.) on Thursday June 19, reportedly dismissed a preliminary objection by Chevron Nigeria Limited, CNL, which purportedly sought to halt ongoing legal proceedings between Chevron Nigeria Limited versus an indigenous company, Jee-Jay International Limited.
Fresh Angle International understands that the Presiding Judge, Hon. (Mrs.) Emudianohwo, reportedly awarded costs against Chevron in Suit No. W/138/2024, paving the way for the substantive suit to commence.
The case stems from a Service Order and Charter Party Agreement, under which Chevron reportedly engaged Jee-Jay to supply critical marine support equipment; two swamp buggies for its offshore operations in July 2019.
The equipment, was duly delivered to Chevron’s Warri Dock and operated at their site, until July 31, 2019, when Chevron reported that both swamp buggies had been burnt overnight by unknown persons.
Despite repeated demands and efforts at amicable resolution, Chevron allegedly refused to return or replace the destroyed equipment or compensate Jee-Jay for its losses.
As a result, Jee-Jay filed a suit, seeking: A declaration that Chevron’s refusal to return the swamp buggies, is unlawful and a breach of contract; among other reliefs.
Speaking after the ruling, Counsel to Jee-Jay International, M. N Uwaifo, described the court’s decision as “a vindication of the principle that contracts must be honored and that access to justice can not be frustrated by procedural roadblocks.”
The court’s refusal to grant Chevron’s request was seen as a victory for indigenous companies, claiming unfair treatment in their dealings with larger multinationals.
Jee-Jay International Limited, a Nigerian-owned oil and gas services company, says it remains committed to upholding the rule of law and recovering its losses through lawful means.
Legal Affairs Manager of Jee Jay International Limited, Barr. Bawo Wesley Edema, was present in court today.
It was gathered in another suit between Chevron Nigeria Limited versus Jee-Jay International Limited, another Judge sitting at High Court, Warri, Hon. Justice V.O. Agboje (Mrs.) also dismissed an originated summons filed by Chevron Nigeria Limited on December 2, 2024.
