About 40 makeshift shops and caravans at Okere Junction by Estate roundabout in Warri illegally erected at a land belonging to a prominent Warri based Estate Surveyor, Mr. Bernard Akporiaye was in the early hours of Monday October 15 demolished.
The demolition which was carried out under the watchful eyes of armed policemen is sequel to a prolonged legal battle which saw Mr. Bernard Akporiaye declared the rightful owner of the land after it was wrongfully taken over several years ago by late Chief Daniel Okumagba.
The Supreme Court had struck out an injunction filed on behalf of late Daniel Okumagba by the Otota of Okere-Urhobo, Chief Wilson Eboh and Co wherein they claimed that Mr. Bernard Akporiaye cannot collect rent for the land.
There was however a twist in the case when Chief Wilson Eboh testified before the Supreme Court on behalf of Olodi, Oki and Ighogbadu families that no member of the three families trespassed on the disputed land and do not have tenants on the land, even though they are strong indications that rents have been collected from shop owners doing business in land over the years.
Prior to the demolition, Mr. Bright Okumagba who was at the scene accused the security agencies that supervised the demolition of bias.
Mr. Akporiaye had through his counsel, Patrick Oganwu and Associates in a notice dated September 3, 2012 instructed illegal occupants of the land to vacate or face forceful eviction after the Supreme Court had in an earlier judgment affirmed the Appeal Court ruling which confirm Mr. Bernard Akporiaye’s ownership of the land.
