Esiegbuya threatens legal action against NNPC Gas Infrastructure Ltd over ‘hazardous pollution’


A resident of Ubeji Community in Warri South Local Government Area of Delta State, Samuel Esiegbuya, has threatened legal action against NNPC Gas Infrastructure Company Limited, over what he described as act of hazardous pollution negatively affecting his health, members of his family and property, as a result of the company’s gas flaring.

 

In a letter addressed to the Managing Director?????, NNPC GAS INFRASTRUCTURE COMPANY LIMITED and made available to Fresh Angle International, Thursday September 28, Esiegbuya, noted: “It's no longer a fact, but rather a legal and unassailable conclusion that the acts of your production and/or exploration of gas in the area to which your Company NNPC Gas Infrastructure Company Limited is operational is detrimental to humans and the environment at large and which I am very certain that you have deliberately failed to take cognizance or responsibility as a corporate entity you are.”

 

He claimed that black soot purportedly emitting from the company’s gas flack located close to his property at No: 4, Agberuku Crescent Ubeji Community, Warri South Local Government Area, has visible proof of damages to him, his family and property.  

 

“I am not also oblivious of the facts of the enormous visible and admissible proofs of damages your Company NNPC Gas Infrastructure has been causing to our health as a family and a people in the area and including property and environmental damages at large for decade and/or presumably time immemorial.

 

“I must state at this point in time and without any iota of intimidation or coercion that several letters one of which dated 20th December 2018 written and addressed to your Firm by J. O. Bakpa Esq., letter dated 18th November 2019, 4th December 2019, 30th April 2021 written and addressed to your Firm in personal capacity and also letter dated 6th June 2021 by J. Unurhoro under the name and Style J. UNURHORO & CO, and again 28th January 2022 written and addressed to the Group Managing Director of Nigerian National Petroleum Cooperation  (erstwhile) NNPC Limited respectively, all on the same above mentioned subject matter of gas flaring and its perennial damages to humans, properties, the environment and its ecosystems without positive response to the complaints neither attempt remediation nor compensation to assuage the mind of the sufferers as all complaints fell on deaf ears and/ or treated with neglects, disdain, levity with outright double standard.

 

“I have exhausted my patience and elasticity over this same repeated matter before you and with the overwhelming and preponderance of evidences at my disposal it is in doubt  considered enough to seek legal redress in the circumstances of the entire fret and I am using this medium to notify you the umpteempt time that within ( 21 days) of your receipt of this letter and if you fail this time and/ or neglect as usual in your corporate social obligations or responsibilities to resolve this issue amicably and timeously, I will be left with no option than to be forced to take a legal action against your Company without further recourse or notification to you or Firm.

 

“I trust you will do the needful in a practicable and timely manner as we can no longer continue to condone or tolerate these excesses of acts of negligence and constant environmental nuisance orchestrating by your group and its operations,” Esiegbuya, emphasized inter-alia.
